The Aargauer Kunsthaus, Aarau (hereinafter referred to as “museum”) delivers any products ordered from the web shop based solely on the following terms and conditions, as applicable at the time of ordering. The museum cannot accept any arrangements that are at variance with these terms and conditions.
A contract is concluded once the museum accepts the customer’s order by means of e-mail confirmation. The broad contents of the order are specified in this confirmation. If the customer, in ordering, has provided the museum with an incorrect e-mail address and the museum’s confirmation e-mail cannot be delivered, the contract will be concluded once the museum sends the customer the confirmation in some other form.
Unless otherwise agreed, the delivery will be made from stock to the delivery address declared by the customer.

The Museum is authorized to make partial deliveries. No additional costs are incurred for the customer. If, at one point, the museum is unable to deliver the products ordered or if there is a delay in shipping, the customer will be notified by e-mail. Should the museum, through no fault of its own, be permanently prevented from delivering the products ordered, it is entitled to withdraw from the contract.
The delivery is made at the customer's expense ex warehouse. The shipping costs depend on the destination and the weight. They are calculated for each order and are shown in the shopping cart. Posters are delivered safely packed in a cardboard tube (up to five posters). The packing of the posters is free of charge. For deliveries outside of Switzerland, import duties such as import tax and customs fees may apply, which the customer must pay. These vary in the different duty areas. The goods are declared for customs by the museum. The customer is responsible for the proper payment of any applicable duties and fees. Import duties are not shipping costs.
All prices are in Swiss Francs (CHF) and include VAT, as required by law (if applicable). The amount due may be paid by credit card or Postcard using Saferpay.
Annual membership fee
The annual membership fee applies to the calendar year (1 January - 31 December). An invoice for paying the annual fee will be mailed to you towards the end of the calendar year. If you acquired membership through the museum’s webshop and paid annual dues by credit card, your credit card will not be debited again for any annual membership fees subsequently due.
Membership may at any time be terminated by the end of the calendar year in writing (e-mail, letter or fax). A written termination notice for the following year should be received by the Aargauischer Kunstverein no later than 30 November of the current year.
Members of the Aargauischer Kunstverein and Friends of the Aargau Art Collection may obtain catalogues and editions at a preferential price. The museum has entrusted Saferpay with settling credit card and Postcard payments and gathering the data required for these payments. As a consequence, the museum has no knowledge of such data. Only the customer’s shipping information (address) is forwarded to the web shop.
The customer’s shipping information is used within the museum only and is not shared with any third party.
The customer has the right to return ordered items up to 14 days after their receipt. The right to return merchandise is limited to manufacturing defects and wrong deliveries. The right to return does not apply to products (CDs, DVDs, videos) that have been unsealed by the customer. When returning items, the customer shall specify the reason for their return. The museum shall replace the item(s) expeditiously. Merchandise should be returned to the following address:
When returning items, the customer shall bear the shipping costs. In case it is not possible to replace a product, the amount paid shall be refunded to the customer.
Claims for damage are excluded, unless the damage is the result of an intentional or grossly negligent act on the part of the museum. The museum is on no account liable for consequential damages and loss of profit. Product liability remains unaffected.
The Museum does not transfer any copyrighted rights of use upon delivery of the goods. The ordered poster reproductions may be used, as far as a copyright exists, only for private purposes; a use for the benefit of third parties or for commercial purposes is not permitted without the permission of the copyright holder.
The delivered goods remain the property of the Museum until all existing claims have been completely settled.
The provisions of Swiss law apply. The place of jurisdiction is Aarau, Switzerland. Should any provision or provisions that are part of these General Terms and Conditions be found invalid or unenforceable, the validity of the remaining provisions shall remain unaffected by this.
