1. Area of application
For the business relationship between the Aargauer Kunsthaus (hereinafter referred to as ‘Museum’) and the purchaser (hereinafter referred to as the ‘Customer’) of goods (including membership of the Aargau Art Association) via the Museum’s webshop, the following General Terms and Conditions apply at the time of purchase.
2. Conclusion of contract
A contract is concluded once the Museum accepts the Customer’s order by means of e-mail confirmation. The essential contents of the order are specified in this confirmation.
3. Shipping time
Unless otherwise agreed, the delivery of the ordered goods will be made ex warehouse to the delivery address declared by the Customer.
The delivery times from confirmation by the Museum are
- Within Switzerland: Usually 7 working days
- Within the EU: Usually 10 working days
- to USA/Japan/overseas: Usually 25 working days.
The Museum is authorized to make partial deliveries. No additional costs are incurred for the Customer for the complete delivery. If at one point the Museum is unable to deliver, or if there is a delay in shipping, the Customer will be notified by e-mail as quickly as possible. Should the Museum, through no fault of its own, be permanently prevented from delivering the products ordered, it is entitled to withdraw from the contract. In this case, the Customer shall be informed and any payments already made refunded. Any further claims are excluded.
4. Prices, shipping costs and duties
All prices are given in CHF and contain the possible legally mandatory Value Added Tax.
Deliveries are made at the Customer’s expense ex warehouse. The shipping costs depend on the destination, form of packaging and weight of the goods. They are calculated for each order and shown in the shopping cart.
Posters are delivered safely packed in a cardboard tube (up to 5 posters).
In the case of deliveries outside of Switzerland import charges (such as customs duties, import sales tax etc) may be incurred, which are to be borne by the Customer. These vary according to the different customs zones. Customs declarations are made by the Museum. The Customer is responsible for the proper settlement of any import charges arising.
5. Means and terms of payment
Payment may be made by credit card or Postcard via Saferpay.
6. Membership of the Aargau Art Association
Annual membership fee
The annual membership fee applies to the calendar year (1 January to 31 December). If you acquired membership through the Museum’s web shop and paid the annual fee by credit card or Postcard, your credit card will not be debited again for any annual membership fees subsequently due. For subsequent annual membership fees members receive a bill for the payment of the annual membership fee by post.

7. Discounts
Members of the Aargau Art Association and Friends of the Aargau Art Collection receive catalogues and editions at a preferential price. Only members of the Aargau Art Association and Friends of the Aargau Art Collection are able to choose the preferential price in the webshop.

8. Use of Saferpay
The Museum has entrusted Saferpay with processing credit card and Postcard payments. The Customer accepts the applicable terms and conditions of Saferpay.
9. Data Protection
The Museum has entrusted Saferpay with processing credit card and Postcard payments and gathering the required data for those payments. As a result the Museum has no knowledge of those data. Only the Customer’s order data (names, address, e-mail, telephone and ordered goods) are passed on to the Museum webshop. These order data are only used within the Museum and not shared with any third party.
10. Returns
The Customer has the right to return ordered items within 14 days of their receipt. The right to return is limited to manufacturing defects and wrong deliveries. The right to return does not apply to goods (CDs, DVDs, videos) that have been unsealed by the Customer. The return of a membership of the Aargau Art Association is also excluded. With regard to resignation the statutes of the aforementioned Association apply. In the event of returns the reason for the return should be given in each instance. The Museum will exchange the goods as quickly possible. The goods should be sent to the following address, giving the order number.

In the case of a return the shipping costs as well as any import charges (duties etc) are to be paid by the Customer. If the product cannot be replaced, the sum paid by credit card or Postcard will be repaid to the Customer in the same way.
11. Liability
Claims for damage are excluded, unless the damage is the result of a deliberate or grossly negligent act by the Museum. In no case is the Museum responsible for consequential damages and loss of profit. Product liability remains unaffected.
12. Rights
The Museum does not transfer any copyrighted rights of use upon delivery of the goods. The ordered poster reproductions may be used, where a copyright exists, only for private purposes; use for the benefit of third parties or for commercial purposes is not permitted without the permission of the copyright holder.
13. Title retention
Until the complete resolution of all existing claims the delivered goods remain the property of the Museum.
14. Applicable law
The provisions of Swiss apply. The UN Convention on the International Sale of Goods (CISG) or any other international agreements are not.
